  1. Confidentiality: Borrower information shall remain confidential except where disclosure is permitted or required by applicable law.
  2. Legal Costs: Any legal, collection, or enforcement costs charged to the Borrower shall not exceed the amounts permitted under applicable Namibian law.
  3. Consent to Judgment: Any consent to judgment or emolument attachment order obtained before default shall be subject to, and enforceable only to the extent permitted by, applicable Namibian law.
  4. Complaints and Dispute Resolution: Any complaint arising from this Agreement should first be submitted to the Lender for resolution. Where the complaint remains unresolved, the Borrower may refer the matter to NAMFISA or any other competent authority, where applicable.
  5. Cooling-Off Period: The Borrower may cancel this Agreement within three (3) business days after signing, subject to repayment of the principal amount advanced and any pro rata finance charges lawfully due.
  6. Early Settlement: The Borrower may settle the outstanding loan amount before the agreed repayment date without an early-settlement penalty, subject to applicable law.
  7. Variation of Agreement: No amendment, extension, repayment arrangement, or other variation of this Agreement shall be valid unless recorded in writing and agreed to by both parties.
  8. Governing Law: This Agreement shall be governed by and interpreted in accordance with the laws of the Republic of Namibia.
  9. Credit Bureau Reporting: Where the Lender intends to submit adverse information concerning the Borrower to a registered credit bureau, the Borrower shall be provided with the notice required under applicable Namibian law.
  10. Late Payment and Default Penalty: Where the Borrower fails to make the required payment within seven (7) calendar days after the agreed repayment date, the account may be considered in default. A late-payment or default charge of thirty percent (30%) of the amount due may be imposed, the client is notified, and a further seven (7) days is given. Failure to pay may result in ITAS listing from day 10, a further 30% charge deducted on payday where auto-debit is enabled, and referral to the legal department if payday funds are insufficient, only to the extent permitted under applicable Namibian law.
  11. Failure to Honour Agreed Repayment Arrangement and Legal Action: The Lender may commence lawful debt-recovery proceedings where the Borrower fails to settle within an agreed repayment period.
  12. Notice Before Legal Proceedings: Where required by law, the Lender shall provide the Borrower with written notice of default and a reasonable opportunity to remedy the default before commencing legal proceedings.
  13. Disclosure Requirements: The Lender shall provide the Borrower with all disclosures and information required under applicable Namibian microlending and consumer-credit legislation and regulations.
